{"id":405,"date":"2023-08-28T19:32:38","date_gmt":"2023-08-28T19:32:38","guid":{"rendered":"https:\/\/hunzavalley.org\/according-to-the-mga-bill-55-is-in-line-with-the-recast-brussels-regulation\/"},"modified":"2023-08-28T19:32:39","modified_gmt":"2023-08-28T19:32:39","slug":"according-to-the-mga-bill-55-is-in-line-with-the-recast-brussels-regulation","status":"publish","type":"post","link":"https:\/\/hunzavalley.org\/according-to-the-mga-bill-55-is-in-line-with-the-recast-brussels-regulation\/","title":{"rendered":"According to the MGA, Bill 55 is in line with the recast Brussels regulation"},"content":{"rendered":"<p><\/p>\n<div>\n<p>The Malta Gaming Authority (MGA), Malta&#8217;s gaming regulator, has strictly protected the hotly debated Bill 55, enacted by Maltese President George Vella in June this year, after being criticized by the latter <em>&#8220;The change is incompatible<\/em> <em>with European law.\u201d<\/em><\/p>\n<h2><strong>The legislation does not conflict with European legislation<\/strong><\/h2>\n<p><noscript><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-19586\" src=\"https:\/\/www.casinonewsdaily.es\/wp-content\/uploads\/sites\/3\/2023\/08\/mga_defends_controversial_bill_55_after_criticism-300x200.jpg?x29555\" alt=\"\" width=\"300\" height=\"200\"\/><\/noscript>In its defense arguments, the <a href=\"https:\/\/www.casinonewsdaily.com\/blog\/2023\/06\/05\/the-malta-gaming-authority-releases-2022-annual-report-and-financials\">MGA<\/a> I announce this <em><strong>&#8220;<\/strong><\/em><strong><em>Bill 55<\/em><\/strong><em>also known as <\/em><strong><em>Malta Gambling Act Section 56A<\/em><\/strong><em>It does not violate European law but protects Maltese licensed operators from it <\/em><strong><em>legal responsibility <\/em><\/strong><em>arising from your gaming activities when the activity is covered by your MGA license.\u201d<\/em><\/p>\n<p>However, the MGA statement comes after <strong>Joint Gaming Authority of the States (GGL)<\/strong>Germany&#8217;s gaming regulator said the bill, now law, violated the <strong>Recast of the Brussels regulation<\/strong>, a 2013 European law that regulates the jurisdiction, recognition and enforcement of court judgments between EU member states.  To show that this is not the case, the MGA stressed a <strong>Section <\/strong>a 2013 European law that says so <em>&#8220;A Member State may refuse to recognize a court judgment if it is not in accordance with the principles of its legal system.&#8221; <\/em>In addition, the Malta Gaming Authority added <em>\u201cThe intention of lawmakers in drafting the law was not <\/em><strong><em>create new exceptions <\/em><\/strong><em>not to regulate, but to enshrine in law Malta\u2019s long-standing public policy in relation to the gambling sector.\u201d<\/em><\/p>\n<p>To show his support for the law, he also said: <em>\u201cThe scope of Bill 55 is extremely restrictive.  The law does not stop all legal action against a licensed Maltese gambling operator, but notes that the law sets certain conditions for doing so. <\/em>However, he emphasized this <em>\u201cAn operator could only be protected from a lawsuit if its gambling activities are restricted <\/em><strong><em>legal <\/em><\/strong><em>under the country\u2019s gambling law and the lawsuit would have to conflict with or undermine the legality of the Maltese gambling framework for Bill 55 to come into force.\u201d<\/em><\/p>\n<h2><strong>Dispute over the legality of Maltese gambling laws<\/strong><\/h2>\n<p>Regarding the legality of their gambling laws, the MGA found the same <em>\u201cHis gambling laws are governed by that <\/em><strong><em>Rules for the free movement of services in Europe.\u201d<\/em><\/strong>    In this regard, he stated: <em>&#8220;In turn, the Maltese gambling framework fully complies with EU law and is based on the freedoms afforded to a company established in the internal market.&#8221;<\/em><\/p>\n<p>But when discussing this particular issue, European governments and regulators stressed <em>&#8220;The <\/em><a href=\"https:\/\/www.casinonewsdaily.com\/blog\/2017\/12\/08\/european-commission-draws-criticism-closure-online-gambling-infringement-cases\/\"><em>Commission decision of 2017<\/em><\/a> <em>Infringement procedures and complaints in the gambling sector to end.\u201d <\/em>In her opinion, this decision means just that <em>&#8220;Gambling services cannot be considered a service that can be broadcast across Europe under an MGA license.&#8221;<\/em><\/p>\n<h2><strong>The European Commission is examining Bill 55<\/strong><\/h2>\n<p>The above-mentioned draft law 55 has already been criticized by some parties for violating European law.
